1. Preamble & Purpose

Neptune Inc. (hereinafter referred to as the "Company," "we," "us," or "our," despite the fact that the Company does not exist in any legally recognized jurisdiction) operates the website located at notmicrosoft2000-cmd.github.io (hereinafter the "Site"). This Privacy Policy is intended to describe, with unnecessary thoroughness, how we handle information when you, the "Visitor" or "User," elect to spend your有限 time on the Site.

We wish to make absolutely clear, for the avoidance of doubt and without limiting the foregoing, that Neptune Inc. is a fictional entity created for creative and educational purposes. The Company is not a real company. It has no offices, no employees, no board of directors (though the toaster has been spotted in the boardroom), and no obligation to any regulatory body. This Privacy Policy, however, is real, in the sense that you are reading it and it applies to your use of the Site, which is also real, unfortunately.

The Company thanks you for reading this far. Most Visitors do not. The Company is not judging you. The Company is merely observing.

2. Information We Do Not Collect

The Company does not collect, transmit, store, process, aggregate, monetize, sell, barter, trade, lend, lease, sublease, or otherwise obtain any personal information on any server, database, cloud instance, punch card, or other data storage mechanism. The Company would not know what to do with your data if it had it, which it does not.

The Site is a static website hosted on GitHub Pages. There is no backend server. There is no database. There is no analytics service that transmits your data to us or to any third party for the purpose of understanding your behavior, which the Company has no interest in understanding, partly because the Company is fictional and partly because it would be creepy.

The Company does not use Google Analytics, Adobe Analytics, Mixpanel, Amplitude, Segment, Heap, Hotjar, FullStory, Plausible, Fathom, Matomo, Umami, PostHog, or any other analytics service. The Company is not even sure what most of those are.

3. Information Stored Locally on Your Device

The Site utilizes your browser's localStorage API to persist certain preferences and state. This data resides exclusively on your device and is never transmitted to us, to GitHub, to any third party, or to any celestial body. The Company has compiled the following exhaustive (and, the Company admits, somewhat tedious) list of stored items:

  • Theme preference — The visual theme you selected. The Company is pleased you made a choice.
  • Simple mode — Whether you enabled or disabled the simplified view. No judgment either way.
  • Reduced motion — Whether you disabled animations. The Company respects your vestibular system.
  • Sound settings — Whether sound effects are enabled. The beeps are optional, but the Company is fond of them.
  • Project matching — Whether the site restyles to match the active project. This is, the Company admits, a purely aesthetic decision with no functional consequence whatsoever.
  • Recently visited — A list of up to 4 project keys you last visited. The Company does not judge your browsing habits.
  • GitHub cache — Cached GitHub API responses for project statistics. These expire after 15 minutes, at which point the Company re-fetches them, whether you asked it to or not.
  • Release seen tags — The last seen release tag for each project, used for update notifications. The Company is very proud of its update notifications.
  • Intro/notification dismissed — Whether you dismissed the welcome toast or navigation hint. If you dismissed it, the Company will not show it again. The Company respects your decision, however misguided.
  • Forum username — If you entered a username in the public forum. The Company hopes you chose wisely.
  • Legal consent — Whether you agreed to the legal documents. The Company is legally required to store this. The Company is also legally required to inform you that it is not legally required to do anything, being fictional.

You may clear all of this data at any time by clearing your browser's localStorage for this Site, or by using your browser's developer tools, or by performing a factory reset on your device, which the Company does not recommend but will not stop you from doing.

4. Third-Party Services

The Site interfaces with certain third-party services. The Company is contractually (allegedly) obligated to inform you of this:

4.1 GitHub API

When you visit a project page, the Site makes requests to the GitHub API (api.github.com) to fetch repository statistics and release information. These requests are made directly from your browser and are subject to GitHub's Privacy Statement. The Company caches the responses in localStorage for 15 minutes to reduce API calls, which the Company feels is a reasonable and neighborly thing to do.

4.2 MQTT Broker

The public forum connects to a third-party MQTT broker (broker.emqx.io) to send and receive messages. Messages are transmitted in plaintext and are visible to anyone subscribed to the topic. The Company strongly advises against sending sensitive information through the forum. The Company also strongly advises against sending insensitive information through the forum, but this is a free country (allegedly). The forum broker is operated by EMQ Technologies Co., Ltd. and is subject to EMQ's Terms of Service.

4.3 Google Fonts

The Site loads typefaces from Google Fonts (fonts.googleapis.com). When you load the Site, Google may receive your IP address, browser information, and a reasonable approximation of your taste in typography. Google's privacy policy applies, and the Company suggests you take it up with Google if you have concerns, because the Company certainly will not.

5. Cookies & Tracking Technologies

The Site does not use cookies. Not first-party cookies, not third-party cookies, not session cookies, not persistent cookies, not supercookies, not zombie cookies, not flash cookies, notEvercookies. The Site does not use web beacons, pixel tags, fingerprinting, device recognition, or any other tracking technology that the Company is aware of. If the Company becomes aware of a new tracking technology, it will not use that either.

The Company would like to take this opportunity to note that it finds cookies to be a perfectly acceptable snack but a deeply inappropriate method of user surveillance.

6. Children's Privacy

The Site is not directed at children under the age of 13, or at children of any age, really, though the Company suspects that children would find the orb quite compelling. The Company does not knowingly collect information from children. The Company does not knowingly collect information from anyone. The Company does not collect information.

7. Data Retention & Deletion

Because the Company does not collect any data, there is nothing to retain. The data stored in your browser's localStorage persists until you delete it, until you clear your browser data, until the heat death of the universe, or until you switch to a different browser, whichever comes first. The Company has no power over your localStorage and would not exercise such power even if it could, on principle.

8. Changes to This Policy

The Company reserves the right to modify this Privacy Policy at any time, for any reason, or for no reason whatsoever. Changes will be reflected on the legal page with an updated effective date. The Company will not notify you of changes, because the Company has no way to contact you, because the Company does not collect your contact information, because this is a Privacy Policy about not collecting information. Continued use of the Site after changes are posted constitutes your acceptance of the updated policy, which you are probably not reading anyway.

9. Contact & Inquiries

For questions about this Privacy Policy, you may contact the Company through the Site's contact page, open an issue on the GitHub repository, or send a carrier pigeon to the usual roof. The Company will respond within 3 to 7 business days, or approximately one pigeon, whichever is sooner. For urgent matters, the seance is available on Thursday evenings, though the Company cannot guarantee the accuracy of the response.

The Company would like to remind you that it is fictional and therefore cannot actually receive or respond to your inquiries. Your patience is appreciated.

10. Governing Disclaimers
This Privacy Policy is a work of creative fiction. Neptune Inc. is a fictional entity. The Company, the Site, the privacy practices described herein, and this Privacy Policy itself are provided for entertainment and educational purposes only. Nothing in this document constitutes legal advice, a legal obligation, or a binding agreement with any real or fictional entity. If you have actual privacy concerns, please consult an actual attorney. The toaster is not qualified.

1. Acceptance of Terms

By accessing, browsing, or otherwise using the Neptune Inc. Hub (hereinafter the "Site"), you (hereinafter the "User" or, when the Company is feeling formal, "the Visitor") agree to be bound by these Terms of Service in their entirety. If you do not agree to these Terms, you are advised to discontinue use of the Site immediately and close this page with the quiet dignity of someone who has just read a Terms of Service agreement and decided, on balance, that it was not for them.

The Company would like to note that it has never actually enforced these Terms against anyone, on account of being fictional, but the Company appreciates your cooperation nonetheless.

2. Description of Service

The Site is a static website that serves as a central hub for projects created by Neptune Inc. It provides navigation between projects, project information, a public forum, a simulated stock market display, a changelog, a project comparison table, a project status dashboard, and various other features that the Company has spent an inordinate amount of time developing. The Site is hosted on GitHub Pages as a static site with no server-side processing, which means there is no server, which means there is no one home, which means the lights are on but nobody is home, metaphorically speaking.

3. Fictional Company & Nature of the Enterprise

Neptune Inc. is a fictional company created for creative and educational purposes. The Company does not exist. It has never existed. It will not exist in the future. Any resemblance to real companies, persons, living or dead, events, or locales is entirely coincidental, and the Company would like to remind you that it is a work of fiction and that you should not, under any circumstances, attempt to invest in it, contact it, sue it, or otherwise interact with it as though it were a real entity.

The stock market display, financial data, news articles, investor information, shareholder lists, risk factors, and all other corporate materials presented on the Site are entirely fictional and algorithmically generated. They should not be construed as financial advice, a solicitation, an offer to buy or sell securities, or evidence that the Company has a marketing department, which it does not.

The Company would like to take this opportunity to note that its CUSIP number (640K 1987) is not a real CUSIP number, its NASDAQ listing (NEPT) is not a real listing, and its headquarters (the hallway) is not a real headquarters, though the hallway does exist in some capacity and does have opinions about zoning.

4. No Financial Advice, Investment Advice, or Advice of Any Kind
Nothing on the Site constitutes financial, investment, trading, legal, tax, medical, dietary, relationship, or any other form of advice. The simulated stock ticker, charts, financial data, and market information are fictional and generated algorithmically using a PRNG seeded with the current date. You are advised, in the strongest possible terms, not to make any financial decisions based on information presented on the Site. If you have made financial decisions based on information presented on the Site, the Company suggests you consult a qualified professional and also possibly a therapist.
5. User Conduct & Prohibited Activities

When using the Site, you agree not to:

  1. Use the Site for any illegal purpose, though the Company is unclear on what illegal purposes one could possibly pursue on a static website about fictional software projects;
  2. Attempt to disrupt, compromise, or otherwise interfere with the Site's infrastructure, though the Site's infrastructure consists entirely of static HTML files and the Company is not sure what there is to compromise;
  3. Abuse the GitHub API or MQTT broker through the Site, though the Company acknowledges that rate-limiting exists for a reason and that reason is you;
  4. Impersonate others in the public forum, though the Company notes that given the forum's quality, impersonation would be a rather elaborate form of vandalism;
  5. Attempt to extract, scrape, or otherwise obtain the source code of the Site, which is already publicly available on GitHub under the MIT License, so this prohibition is largely theoretical;
  6. Send unsolicited communications through the forum, because the pigeon has enough to deliver already;
  7. Engage in any conduct that the Company, in its sole and absolute discretion, determines to be harmful, objectionable, or inconsistent with the spirit of the Site, which is to be a weird little corner of the internet where a fictional company pretends to be real.
6. Public Forum & User-Generated Content

The Site includes a public forum powered by a third-party MQTT broker. Messages are public, visible to all users, transmitted in plaintext, and stored in the browser's memory only (not persisted to disk). You are solely responsible for the content you post. Do not post illegal, harmful, sensitive, or otherwise inadvisable content.

The Company is not responsible for messages posted by third parties. The Company is not responsible for messages posted by first parties. The Company is not responsible for messages, period. The Company is fictional and has no legal capacity to assume responsibility for anything, including but not limited to the quality of discourse in the public forum, which has been described as "adequate" by the hallway.

The Company reminds you that the forum broker is operated by EMQ Technologies Co., Ltd. and is subject to their terms of service. The Company suggests you read those terms as well, though the Company suspects you will not.

7. Intellectual Property

The Site's source code is open source and available on GitHub under the MIT License. You are free to use, modify, and distribute the source code, provided you include the copyright notice and permission notice, which is a small price to pay for the privilege of owning a piece of a fictional company's codebase.

Project names, descriptions, and creative content are the intellectual property of their respective creators, who are, for the most part, the same person, who is also the person who created the fictional company, which means the intellectual property situation is, to put it diplomatically, somewhat circular.

Third-party assets (fonts, icons, and the general vibe) are used under their respective licenses. See the Licenses section below for details.

8. Third-Party Links & Services

The Site contains links to third-party websites and services, including but not limited to GitHub, EMQ, and Google Fonts. These links are provided for your convenience. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites. The Company suggests you read their terms and policies, though the Company acknowledges the irony of a fictional company telling you to read terms and policies.

9. Disclaimer of Warranties
The site is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, noninfringement, and the implied warranty that the site will be available when you want to use it, which the company cannot guarantee, on account of being fictional and also because github pages occasionally goes down.
The company does not warrant that the site will be uninterrupted, error-free, free of harmful components, free of typographical errors, free of factual inaccuracies (being fictional, all facts are inaccurate), or that it will meet your expectations, which the company hopes are modest.
10. Limitation of Liability
In no event shall Neptune Inc., its creators, its contributors, its toaster, its hallway, its pigeon, its orb, or any other alleged entity associated with the company be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, loss of use, data, or profits; business interruption; or the existential realization that you have just spent time on a fictional company's website reading its terms of service) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of this site, even if advised of the possibility of such damage.

The Company would like to remind you, for the avoidance of doubt and without limiting the foregoing, that this is a fictional website. There are no real damages to speak of. The Company is sorry if this is disappointing.

11. Indemnification

You agree to indemnify, defend, and hold harmless Neptune Inc. (a fictional entity), its creators (a real person who would rather not be sued), its contributors (see: creator), and its alleged associates (a toaster, a hallway, a pigeon, an orb, a floppy disk, and an echo) from and against any and all claims, damages, losses, liabilities, costs, and expenses arising from your use of the Site, though the Company is not sure how your use of a static website could possibly give rise to any of these things.

12. Modifications to Terms

The Company reserves the right to modify these Terms at any time, for any reason, or for no reason whatsoever, though the Company acknowledges that it has better things to do. Changes will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms, whether you have read them or not, which you have not.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Site shall be resolved through binding arbitration, though the Company is not sure how you would arbitrate with a fictional company, and neither is the toaster.

14. Severability

If any provision of these Terms is found to be unenforceable, invalid, or otherwise ridiculous (which, the Company concedes, is possible), the remaining provisions shall remain in full force and effect, because the Company has copied this clause from every other Terms of Service agreement and sees no reason to stop now.

15. Entire Agreement

These Terms, together with the Privacy Policy and Licenses, constitute the entire agreement between you and Neptune Inc. (a fictional entity) regarding your use of the Site. This agreement supersedes all prior agreements, understandings, and representations, whether written or oral, though no prior agreements exist because the Company was just created and this is the first time anyone has read these Terms.

The Company thanks you for reading the Terms of Service in their entirety. Your dedication to legal compliance is noted and appreciated. The Company hopes you have a pleasant day.

2. Fonts — IBM Plex Mono

The IBM Plex Mono typeface is used throughout the Site. It is licensed under the SIL Open Font License, Version 1.1. The Company finds it to be a perfectly acceptable monospace font and hopes you do too.

3. Fonts — VT323

The VT323 typeface is used for the Intel debug easter egg page, because the Company felt that a green-on-black terminal aesthetic required a terminal font, and the Company was right.

4. Fonts — Dancing Script

The Dancing Script typeface is used for headings in the webring default theme, because the Company wanted the webring to feel slightly less corporate than this page, which, in retrospect, was an ambitious goal.

5. Third-Party Services
5.1 MQTT Broker (EMQX)

The public forum uses the EMQX MQTT broker (broker.emqx.io), operated by EMQ Technologies Co., Ltd. Usage is subject to EMQ's Terms of Service. The Company would like to note that the broker is free and that the Company is grateful for its existence, though the Company has never met EMQ and cannot vouch for their character.

5.2 GitHub API

Repository statistics and release information are fetched from the GitHub API. Usage is subject to GitHub's Terms of Service. The Company would like to note that GitHub is a subsidiary of Microsoft, which is a real company, unlike Neptune Inc., and that the Company has no comment on the irony of a fictional company hosting its fictional operations on a real company's infrastructure.
